Convicted in the nation's first felony case against illegal spamming , Jeremy Jaynes, 30, on Friday was sentenced to nine years in prison for bombarding Internet users with the junk e-mails.

But Loudoun County Circuit Judge Thomas Horne delayed the start of Jaynes' prison term while the case is appealed, saying the law is new and raises constitutional questions.

Jaynes was convicted in November for using false Internet addresses and aliases to send mass e-mail ads through an AOL server in Loudoun County, where America Online is based. Under Virginia law, sending unsolicited bulk e-mail itself is not a crime unless the sender masks his identity.

While prosecutors presented evidence of just 53,000 illegal e-mails, authorities believe Jaynes was responsible for spewing out 10 million e-mails a day. Prosecutors say his operation grossed up to $750,000 per month.

A jury recommended the nine-year term for the Raleigh, North Carolina, man.

Prosecutor Lisa Hicks-Thomas said she was pleased with Friday's ruling – and confident the law would be upheld on appeal.

I remember hearing that they were trying to write out the anti-spamming laws in Australia last year, but I never heard what came of it.

I assumed that Spyware and Adware were created by the firewall manufacturers to increase sales. Oh well, nice to see someone getting sent down for it anyway, I wonder if he'll get internet access in prison.

Don't cheer.

The weasel lawyers will find away to make spamming legal, even though NOBODY WANTS IT.

Why can't there just be a law based on what people don't want, not what the system does not want.

Take a poll along side the next presidential elections. You can vote for president and vote for wether you feel spamming should be highly illegal, with sentences of up to 10 years.

I have a far better punishment. He should get an email in box with approximately ten billion messages in it. One of them will be an email declaring his release and the other ninety nine billion will be spam. He can be released as soon as he sorts through them!

This is nonsense. I already get junk mailed delivered to my door every day, and that is legal. Some guys sends out loads of electronic junk that I can easily filter and delete (no big deal), he figures out a way to make money by it (good for him), and his initial sentence is nearly twice the average term for violent rape (WHAT!???!).

This continent is fucked.

Yeah, 9 years is a ridiculous sentence. Sure, it's obnoxious, but there are better people to waste our tax dollars that support the prison economy on. Like the rapists and murderers and guys who rip tags off of matresses... Oh those bastards...

I get alot.

at one point i was getting at least 200 a day. It cost me so much time, i accidentally deleted so many important emails in the process, and consequentially lost contacts, paid work, etc.

most people on dial up have to constantly scan their computure for spyware (which is totally realted to spam and pop ups) otherwise their bandwidth gets used up by these assholes and prevens them from being able to use the internet.

my father is constantly bombarded with cold canvas calls that get diverted to his mobile and he has to pay for the calls and redirection fee. there is no filter for that!!!

Fuck, it's people like this who made it so that pop music and television is nothing but comercialised, non-risk, non-entertaining, non-educational, non-mind-expanding, garbage. These people have us feeding on our own waste like fucking pigs, with reality TV and 24hour infomercials!!!

everytime mankind takes another step forward in comunicative technology these parasites destroy it. the telephone used to be useful, now it's just telemarketing, cold canvasing, charity calls, rafle calls, recorded auto dialers, etc. Television used to be watchable but now it sucks!!! They are holding us back, and buring us in mind destroying, art hating, money stealing, information spying, bullshit !!!

AND THEY DESERVE TO DIE A VIOLENT FUCKING DEATH!!!

With junk mail, you're much more likely to get a legitimate offer from a legitimate company with a legitimate CEO that you can write angry letters to, or assassinate, if you so choose. With spam, you're at the mercy of a man who dreams of nothing more than running and taking your money, and not in that order.

You're also less likely to get ads for VI@RG12A or Nigerian scams through the postal service. And I have never in my life seen a paper letter offering phallic enhancement.

Anyway, the reason lawmakers have tougher penalites for spam rather than rape is because spam is the crime they're less likely to commit.

Also take into account that spammers don't care who they send it to, as long as it goes out. Hence, there is nothing to stop a primary school child receiving pictures of Iraqui women being raped during the recent/current war(I actually got this spam *shudders*).
